Mediation is a process in which the participants, with the support of the qualified mediator, identify issues, develop options, consider alternatives and make decisions about future actions and outcomes.
The mediator acts as an independent third party to support and facilitate participants to reach their own decision. Mediators do not advise upon, evaluate or determine disputes. They assist in managing a structured process of dispute and conflict discussion and resolution such that the participants agree upon the outcomes themselves, when appropriate. Mediation is essentially a process that maximises the self-determination of the participants.
Mediation offers a far less expensive dispute resolution option than engaging lawyers to negotiate on your behalf or going to court, and it is usually much quicker as well. Additionally, unlike the adversarial nature of lawyer negotiations and court trials which usually destroy any chance of having a healthy functional relationship after the dispute is finally resolved, mediation can offer a means to resolve the issues whilst also keeping the relationship intact. This is a very important potential benefit of mediation if the participants will need to stay in contact with each other after their dispute has been resolved as part of their ongoing normal life, family, work or community activities.
